Immigration Forms Specialist

According to the USCIS, anyone with the proper training may provide limited, non-legal help with immigration forms and charge for those services. An Immigration Forms Specialist (IFS) is someone who helps people complete immigration forms to enter and live in the United States. To fill out these official forms correctly requires English-language fluency. Strong attention to detail is needed to prepare the submission packages to meet the requirements of U.S. Citizenship and Immigration Services. #immigration forms travel letter

What services can Immigration Forms Specialists provide?

An IFS/notary may provide non-legal immigration services in New York. Generally, these are services that do not require an attorney, unless your state requires you to be an attorney to provide immigration consultation.  


Examples of non-legal immigration services include:  

  • Helping people complete immigration forms and applications 
  • Translating a person’s answers to questions on the immigration forms. 
  • Help a person collect supporting documents, such as birth certificates, or other vital records that may be needed to complete immigration forms. 
  • Collecting support documents, such as birth certificates or other vital records, required for the application. 
  • Submitting completed forms to immigration authorities on an applicant’s behalf. 
  • Making referrals to attorneys to provide legal representation in an immigration matter.

I-9 Verification

What is the I-9 Form?

The I-9 form, issued USCIS verifies the identity and employment eligibility for employees hired in the U.S. The form is to be completed by both the employee and the employer (or authorized representative). 


As part of the process, the employee must present documents verifying his or her eligibility to work in the U.S. The notary (authorized representative) then reviews the employee’s identity documents while the employee is in their presence and completes Section 2 of the form. No notarization required.

POWER OF ATTORNEY

A power of attorney is a legal document that allows a principal to appoint an agent to act for them should they become incapacitated. The agent is expected to place the principal’s interests ahead of his or her own, which is why it is important for you and your loved one to pick a trusted individual. There are multiple types of decisions that the agent can be given the power to make, so there are four types of power of attorney. 


Attorneys are unnecessary to execute a power of attorney. However, it may be wise to consult one for advice about the powers being granted, to provide counsel on your candidate agent, and to make sure your document meets all legal requirements.

1. General Power of Attorney

In this situation, the agent can perform almost any act as the principal, such as opening financial accounts and managing personal finances. A general power of attorney arrangement is terminated when the principal becomes incapacitated, revokes the power of attorney or passes away. 

2. Healthcare POA (Medical Proxy)

A health care power of attorney grants your agent authority to make medical decisions for you if you are unconscious, mentally incompetent, or otherwise unable to make decisions on your own. While not the same thing as a living will, many states allow you to include your preference about being kept on life support. Some states will allow you to combine parts of the health care POA and living will into an advanced health care directive. 

3. Special or Limited Power of Attorney

In this instance, the agent has specific powers limited to a certain area. An example is a power of attorney that grants the agent authority to sell a home or other piece of real estate, managing real estate, collecting debts, and handling business transactions are some of the common matters specified in a special power of attorney document. 

4. Durable Power of Attorney

This arrangement designates another person to act on the principal’s behalf and includes a durable clause that maintains the power of attorney after the principal becomes incapacitated. 

Revoking a POA

Remember, you can revoke a power of attorney at any time. Simply notify your agent in writing and retrieve all copies of your power of attorney. Notify any financial institutions and the County Clerk's office, if applicable, that your agent's power of attorney has been revoked.
